Landing inside one of these categories can materially change your project’s economics — but only if your specific activity actually qualifies.

Article 9 defines which sectors are eligible for tax and land-fee incentives — it is not a complete list of every sector open to investment in Laos. Sectors outside these nine categories (for example ordinary retail, general services, or standard manufacturing not tied to import-substitution/export) remain open to investment as General Business, simply without this specific incentive layer.

Sectors Typically Investigated Through the Concession Pathway
Some major areas of investment activity in Laos — most notably energy (particularly hydropower) and mining — are not listed among the nine Article 9 incentive categories, but represent significant historical and ongoing investment activity. These sectors typically involve State land, natural-resource rights, or large-scale infrastructure, and generally proceed through the Concession Business pathway rather than General Business sectoral incentives.

How Investment May Occur
The Law on Investment Promotion recognizes five investment forms that can apply across sectors: wholly domestic or foreign-owned investment, joint investment between domestic and foreign investors, contract-based business cooperation (no new legal entity required), joint investment between a State-owned enterprise and a private enterprise, and Public-Private Partnership investment. Which form fits depends on your activity, capital structure and, for infrastructure, whether public-sector participation is involved — not on sector alone.
Controlled Activities
Some activities — regardless of sector — may be classified as Controlled Business, meaning they carry additional security, public-order, environmental or other sensitivity and require an investment license before a business operating license. Sector classification under Article 9 and Controlled Business status are separate questions; a promoted sector can still contain individual activities that are also controlled.
